Spousal Sponsorship
Canada’s Spousal Sponsorship program is designed to help families stay together while supporting Canada’s immigration goals of promoting stable family reunification. The program is managed by Immigration, Refugees and Citizenship Canada (IRCC) and follows strict verification procedures to ensure that relationships are genuine and meet legal requirements.
Under this program, Canadian citizens and permanent residents can sponsor their legally married spouse, common-law partner, or conjugal partner to obtain permanent resident status. The sponsor must demonstrate the ability to provide financial and emotional support for their partner for a set period after the partner arrives in Canada.
The program also allows couples to build their family life together in Canada while contributing to the Canadian economy and community life. The Canadian government places strong emphasis on ensuring that relationships are genuine and ongoing, which is why detailed relationship documentation is required during the application process.
Who Can Be Sponsored Under Spousal Sponsorship?
Spousal sponsorship recognizes three types of relationships:
1. Legally Married Spouse
- Applies to couples who are legally married in Canada or abroad.
- Same-sex and opposite-sex marriages are equally recognized under Canadian immigration law.
2. Common-Law Partner
- Couples who have lived together continuously for at least 12 months in a marriage-like relationship.
- Proof of shared residence, finances, or social commitments may be required.
3. Conjugal Partner
- For partners who have a committed relationship for at least one year but could not live together due to legal, immigration, or cultural barriers.
Types of Spousal Sponsorship Applications
Inland Spousal Sponsorship
- Designed for couples already living together in Canada.
- Suitable if the sponsored partner holds a valid temporary status such as a work permit, study permit, or visitor visa.
- Allows couples to stay together in Canada while the sponsorship application is being processed.
- Sponsored partners may apply for an Open Work Permit to work for most Canadian employers.
- Helps partners maintain financial stability during the application processing period.
- Applicants must maintain valid immigration status while the application is under review.
- Strong proof of cohabitation, relationship authenticity, and shared responsibilities is required.
- Leaving Canada during processing may create re-entry risks depending on individual travel documents.
Outland Spousal Sponsorship
- Designed for couples where the sponsored partner is living outside Canada during the application process.
- Suitable for couples maintaining international relationships or temporarily living in different countries.
- Allows the sponsored partner to travel in and out of Canada (subject to valid visa and entry requirements).
- Often preferred when the sponsored partner wants flexibility to stay in their home country while the application is processed.
- Applications are usually processed through IRCC offices outside Canada depending on the applicant’s country of residence.
- Sponsored partners must complete medical examinations, background checks, and security screening.
- Applicants should provide strong proof of relationship authenticity such as photos, communication records, travel history, and shared commitments.
- Outland sponsorship applicants can stay connected with their sponsor in Canada during the processing period.
Sponsorship Eligibility Requirements
To sponsor a spouse or partner, the sponsor must meet several requirements set by Immigration, Refugees and Citizenship Canada (IRCC):
- Must be a Canadian citizen or permanent resident.
- Must be at least 18 years of age.
- Must reside in Canada (Canadian citizens living abroad may need to show intent to return to Canada).
- Must demonstrate the ability to financially support the sponsored partner.
- The sponsor must sign a sponsorship undertaking agreement promising financial support for:
- 3 years for spouse or partner sponsorship.
Processing Time for Spousal Sponsorship Applications
Processing time for spousal sponsorship applications can vary depending on several factors, including the completeness of the application and the country where the sponsored partner is residing. On average, spousal sponsorship applications may take between 12 to 26 months to be processed by IRCC. However, processing times are not fixed and can change based on the volume of applications received and the complexity of individual cases. Factors that can influence processing time include the accuracy and completeness of submitted documents.
Submitting well-organized documents and strong proof of a genuine relationship can help reduce delays and support smoother processing.
